Terms & Conditions
IMPORTANT: in submitting an event booking form you will be deemed to have read, understood and be bound by the following terms & conditions.
At The Saltire Mountaineering Company we pride ourselves on attention to health and safety, providing a professional, controlled and enjoyable experience is our utmost priority. Many of the environments we venture into will present hazardous conditions.

Participants will be asked to revalidate certain details within their booking form on arrival at our meeting point prior to participation of any event, e.g. no changes to medical notes.

A parental consent form must be completed for anyone under 18 years of age participating in an event delivered by The Saltire Mountaineering Company. Anyone under the age of 18 must be accompanied by a parent/guardian.

1. Risk acceptance
The client acknowledges that the nature of participation in The Saltire Mountaineering Company’s event is potentially hazardous and if unwilling to accept the risks associated with participation they will withdraw themselves from the event. Participation is done so ENTIRELY AT YOUR OWN RISK.

2. Insurance and Safety
All guides provided by The Saltire Mountaineering Company will be fully qualified, hold their own full public liability insurance and have the necessary experience of the terrain and route(s). It is the nature of adventurous activities that there will always be some degree of risk. Our insurance does not cover you for inherent risks or client negligence, any client observed to be acting out with the guidelines presented by their guide(s) will forfeit all protection provided by The Saltire Mountaineering Company. Clients will comply with all instructions, decisions, advice and safety regulations given by their guide(s), and use any equipment as directed.

We reserve the right to make changes to planned routes and venues in the presence of adverse or impending conditions, our guide(s) will always use experience and expertise to ensure a safe enjoyable experience over any pre-determined objectives. Cancellation of the event will always be last course of action, in this situation there will be no client entitlement to refund.

3. Booking fees
Bookings will be confirmed upon receipt of a fully completed booking form and 25% deposit. The outstanding balance is due four weeks prior to the event. If a booking is made less than four weeks in advance of the event the full balance will be payable immediately. An invoice with bank details and payment schedule will be provided by email upon receipt of the booking form.

4. Cancellations
Whilst every effort is made to ensure that advertised events materialise, The Saltire Mountaineering Company will notify of cancellation as soon as possible if it has any concerns for safety, e.g. amber/red weather warnings, winter conditions or do not travel alerts. Under such circumstances we will offer a free transfer to an alternative date or activity of the same value (where available), failing this a full refund less a £10 administration fee will be provided. The Saltire Mountaineering Company will not be liable for any associated losses or expense resulting from force majeure.

Should the client have to cancel their participation they will do so by email, The Saltire Mountaineering Company will refund:

More than 4 weeks notice given– 75%

Less than 3 weeks notice given – 50%

Less than 2 weeks notice – 0%

The Saltire Mountaineering Company will not be responsible for lateness or non-arrival due to breakdown, traffic or unplanned timings and no refunds will be given. Whilst not mandatory clients may wish to arrange their own cancellation insurance and/or personal accident insurance.

5. The Saltire Mountaineering Company requires a reasonable level of fitness to take part. If we feel clients are physically unfit to partake in the event, where harm could be caused to themselves or other participants, The Saltire Mountaineering Company reserve the right to remove clients from the event, no refund will be provided under these circumstances.
​
6. The Saltire Mountaineering Company will provide a kit list upon receipt of a booking form but does not provide kit, our guide(s) will however be in possession of group kit consisting of an emergency shelter and group first aid kit. If we feel clients have not adhered to the kit list, where harm could be caused to themselves or other participants, The Saltire Mountaineering Company reserve the right to remove clients from the event, no refund will be provided under these circumstances.

7. Alcohol and Drugs
The Saltire Mountaineering Company also reserves the right to refuse participation to clients that they believe to be under the influence of alcohol or drugs and in such circumstances no refunds shall be given.

8. First Aid administration
In the event of an incident clients give full permission for the relevant guide(s) who are suitably trained in First Aid to administer whatever First Aid treatment they deem appropriate.

9. Parental Consent
It is a legal requirement for anyone under the age of 18 years to have parental consent. Parental consent forms are available upon request and must be completed prior to joining us on any activity, unless the parent/guardian is taking part in the activity with them.

10. Website content
Whilst The Saltire Mountaineering Company aim to maintain up to date information through www.saltiremc.co.uk it is acknowledged there may be inconsistencies from time to time. See condition 2 above concerning potential change to our schedule of events.
​
11. Promotions
Promotional offers and/or incentives may be available from time to time. The Saltire Mountaineering Company and our partners providing such promotions reserve the right to withdraw any offers without notice. Any promotion will be honoured upon confirmation of an event booking.
​
12. Donations
The Saltire Mountaineering Company may opt to donate to charitable causes from time to time, when doing so we will provide full transparency of donation values. The Saltire Mountaineering Company and our charitable partners reserve the right to terminate any agreement or contract without notice.
​
13. Marketing material
I accept The Saltire Mountaineering Company may take photographs and/or any other record of my participation on this event for any legitimate purpose. I understand that any such records captured prior to or during the event will become the sole property of The Saltire Mountaineering Company.

14. Privacy Policy
The Saltire Mountaineering Company maintains the privacy of all data and does not transfer personal information to any third party. Our full policy can be found at www.saltiremc.co.uk

Release
​
The client acknowledges and accepts that representatives of The Saltire Mountaineering Company shall not be held liable for any loss or damage arising from the clients participation in the activities on this event, including indirect or consequential loss or damage.
​
Nothing in this disclaimer shall be construed as limiting or excluding The Saltire Mountaineering Company’s liability for:
(a) personal injury or death which arises consequentially through negligence of a representative of The Saltire Mountaineering Company; or
(b) fraudulent misrepresentation; or
(c) any other matter for which it would be illegal or unlawful for The Saltire Mountaineering Company to exclude or attempt to exclude its liability.

If any court or competent authority finds that any provision of this document (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this agreement shall not be affected.
